General Conditions
General conditions of contract for the sale of tourist packages
constitute an integral part of the travel package contract. This also includes the booking confirmation sent by the organizer to the seller, acting as the traveler's agent, which the traveler will have the right to receive from the organizer. When signing the travel package purchase proposal, the tourist/traveler must keep in mind that the proposal constitutes an acceptance, for themselves and for the individuals for whom they are requesting the all-inclusive service, of both the travel contract as regulated therein, the warnings contained therein, and these general conditions.
1. LEGISLATIVE SOURCES
The sale of tourist packages and related services is governed by the Tourism Code (Articles 32 to 51-novies) as amended by Legislative Decree 62/2018 implementing EU Directive 2015/2302 and subsequent amendments, as well as by the provisions of the Civil Code regarding transport, service contracts and mandates, as well as by the Navigation Code, where applicable.
2. ADMINISTRATIVE REGIME
The organizer and the intermediary of the tourist package, to whom the tourist turns, must be authorized to carry out their respective activities in accordance with applicable administrative regulations, including regional ones.
3. DEFINITIONS (ART. 33 CdT )
For the purposes of this contract, the following definitions apply: a) Traveler: anyone who intends to conclude or stipulate a contract or is authorized to travel under an organized tourism contract; b) Professional: any natural or legal person, public or private, who, in the context of their commercial, industrial, artisanal, or professional activity, acts, in organized tourism contracts, including through another person acting in their name or on their behalf, as an organizer, seller, professional facilitator of related tourist services, or supplier of tourist services, pursuant to applicable legislation; c) Organizer: the professional who combines packages and sells or offers them for sale directly or through or together with another professional; d) Seller: the professional other than the Organizer who sells or offers for sale packages combined by an organizer.
4. DEFINITION OF TOURIST PACKAGE (ART. 33, paragraph 1, no. 4, letter c ) CdT )
A package travel is defined as the "combination of at least two different types of travel services for the purpose of the same trip or holiday, if at least one of the following conditions applies: 1) such services are combined by a single trader, even at the traveler's request or in accordance with his selection, before a single contract for all the services is concluded; 2) such services, even if concluded with separate contracts with individual travel service providers, are: 2.1) purchased at a single point of sale and selected before the traveler agrees to pay; 2.2) offered, sold or invoiced at a flat rate or all-inclusive price; 2.3) advertised or sold under the name "package" or similar name; 2.4) combined after the conclusion of a contract whereby the trader allows the traveler to choose from a selection of different types of travel services, or purchased from separate traders through linked electronic booking processes where the traveler's name, payment details and email address are transmitted by the trader with whom the first contract is concluded to one or more traders and the contract with the latter or these professionals is concluded no later than 24 hours after confirmation of the booking of the first tourist service.
5. PRE-CONTRACTUAL INFORMATION FOR THE TRAVELER (ART. 34 CdT )
Before concluding the package travel contract or a corresponding offer, the organizer and, if the package is sold through a retailer, the retailer as well, shall provide the traveler with the relevant standard information form referred to in Annex A, Part I or Part II of the CdT , as well as the following information: a) the main characteristics of the travel services, such as: 1) the travel destination or destinations, the itinerary and periods of stay with related dates and, if accommodation is included, the number of nights included; 2) the means, characteristics and categories of transport, the places, dates and times of departure and return, the duration and location of intermediate stops and connections; if the exact time is not yet established, the organizer and, where applicable, the retailer, shall inform the traveler of the approximate times of departure and return; 3) the location, main characteristics and, where applicable, the tourist category of the accommodation in accordance with the regulations of the country of destination; 4) the meals provided; 5) the visits, excursions, or other services included in the total agreed price of the package; 6) the tourist services provided to the traveler as part of a group and, if so, the approximate size of the group; 7) the language in which the services are provided; 8) whether the trip or holiday is suitable for persons with reduced mobility and, upon request by the traveler, precise information on the suitability of the trip or holiday taking into account the traveler's needs; b) the commercial name and geographical address of the organizer and, where applicable, the retailer, their telephone numbers and email addresses; c) the total price of the package including taxes and all fees, charges, and other additional costs, including any administrative and handling fees, or, where these cannot be reasonably calculated before the conclusion of the contract, an indication of the type of additional costs the traveler may still have to bear; d) the payment methods, including any amount or percentage of the price to be paid as a deposit and the timetable for payment of the balance, or the financial guarantees that the traveler is required to pay or provide; e) the minimum number of people required for the package and the deadline referred to in Article 41, paragraph 5, letter a), before the start of the package for the possible termination of the contract in the event that this number is not reached; f) general information concerning passport and visa requirements, including the approximate timeframes for obtaining visas and health formalities in the destination country; g) information on the traveler's right to withdraw from the contract at any time before the start of the package upon payment of appropriate withdrawal fees, or, where applicable, the standard withdrawal fees required by the organiser pursuant to Article 41, paragraph 1 CdT ; h) information on the optional or mandatory subscription to insurance that covers the costs of unilateral withdrawal from the contract by the traveler or assistance costs, including repatriation, in the event of accident, illness, or death; i) the details of the coverage referred to in Article 47, paragraphs 1, 2, and 3 of the CdT . 2. For package travel contracts referred to in Article 33, paragraph 1, letter d), concluded by telephone, the organizer or professional shall provide the traveler with the standard information referred to in Annex A, Part II, of this decree, and the information referred to in paragraph 1.
6. CONCLUSION OF THE PACKAGE TOUR CONTRACT (ART. 36 CdT )
1. The travel package sale proposal must be drawn up on a specific contractual form, if applicable electronically or, in any case, on a durable medium, completed in its entirety and signed by the customer, who will receive a copy. Acceptance of the travel package sale proposal is deemed finalized, with consequent conclusion of the contract, only when the organizer sends the relevant confirmation, including electronically, to the traveler at the selling agency, which will ensure its delivery to the traveler. 2. The contract may also be stipulated via online booking platforms, and in such cases, it will be deemed finalized for the traveler upon payment of the deposit of the price in the amount and within the terms indicated in the booking confirmation. 3. Information relating to the travel package not contained in the contractual documents, brochures, or other written communication means will be provided by the organizer, in proper fulfillment of the obligations set forth in Article 36, paragraph 8, of the Italian Travel Code , before the start of the trip. 4) Special requests regarding the methods of provision and/or execution of certain services included in the travel package, including the need for assistance at the airport for persons with reduced mobility, or requests for special meals on board or at the destination, must be made at the time of booking and be the subject of a specific agreement between the Traveler and the Organizer, through the agent agency. 5. In the case of contracts negotiated away from commercial premises, the traveler has the right to withdraw from the travel package contract within five days of the date of conclusion of the contract or from the date on which the contractual conditions and preliminary information are received, if later, without penalty and without providing any reason. In the case of offers with significantly lower rates than current offers, the right of withdrawal is excluded. In the latter case, the organizer must document the price change, adequately highlighting the exclusion of the right of withdrawal (Article 41, paragraph 7, CdT ).
7. PAYMENTS
1. Unless otherwise indicated in the pre-contractual information or in the contract, upon signing the purchase proposal for the travel package, the following must be paid: a) the registration or administration fee (see art. 8); b) a deposit of 30% of the price of the travel package published in the catalogue or in the package quotation provided by the Organizer, without exception within the deadline indicated in the booking confirmation. The balance must be paid without exception within the deadline established by the Tour Operator in its catalogue or in the booking confirmation for the requested service/travel package ; 2. For bookings made after the date indicated as the deadline for payment of the balance, the entire amount must be paid upon signing the purchase proposal; 3. Failure to pay the above amounts by the established dates, as well as failure to remit to the Tour Operator the amounts paid by the Traveller to the selling Agency, and without prejudice to any guarantee actions pursuant to art. 47 CdT against the latter, constitutes an express termination clause pursuant to art. 1456 of the Italian Civil Code, which determines the automatic termination of the contract by simple written communication, via fax or email, to the selling agency or to the traveler's email address, if provided. The price is considered settled when the sums are received by the organizer directly from the traveler or through the intermediary agency selected by the traveler.
8. PRICE (ART. 39 CdT )
1. The price of the travel package is determined in the contract and/or booking confirmation, with reference to what is indicated in the catalog, or non-catalog program and any subsequent updates to the catalogs or non-catalog programs, or on the Operator's website. 2. After the conclusion of the travel package contract, prices may be increased by the amount indicated by the Organizer, up to a maximum of 8% only if the contract expressly provides for this and specifies that the traveler is entitled to a corresponding price reduction, as well as the methods for calculating the price revision. In this case, the traveler is entitled to a price reduction corresponding to the reduction in costs referred to in paragraph 2, letters a), b), and c), which occurs after the conclusion of the contract and before the start of the package. 3. Price increases are possible exclusively as a result of changes in: a) the price of passenger transportation based on the cost of fuel or other energy sources; (b) the level of taxes or charges on travel services included in the contract imposed by third parties not directly involved in the performance of the package, including landing, disembarkation, and embarkation taxes at ports and airports; (c) the exchange rates applicable to the package. 4. If the price increase referred to in this Article exceeds 8 percent of the total price of the package, Article 40, paragraphs 2, 3, 4, and 5 of the CdT shall apply . 5. A price increase, regardless of its amount, is possible only after the organizer has communicated it clearly and precisely on a durable medium to the traveler, together with the justification for such increase and the methods of calculation, at least twenty days before the start of the package. 6. In the event of a price decrease, the organizer is entitled to deduct the administrative and management costs of the actual procedures from the refund due to the traveler, of which he is required to provide proof upon the traveler's request.
9. MODIFICATION OR CANCELLATION OF THE TOURIST PACKAGE BEFORE DEPARTURE (ART. 40 CdT )
Before the start of the package, the organizer may not unilaterally modify the terms of the contract other than the price pursuant to Article 39, unless this right has been reserved in the contract and the change is of minor importance. The organizer shall communicate the change to the traveler clearly and precisely on a durable medium. 2. If, before the start of the package, the organizer is forced to significantly modify one or more main features of the travel services referred to in Article 34, paragraph 1, letter a), or cannot meet the specific requests referred to in Article 36, paragraph 5, letter a), or proposes to increase the price of the package by more than 8 percent pursuant to Article 39, paragraph 3, the traveler, within a reasonable period specified by the organizer, may accept the proposed change or withdraw from the contract without paying a withdrawal fee. In the event of withdrawal, the organizer may offer the traveler a replacement package of equivalent or higher quality. 3. The organizer shall inform the traveler, without undue delay, clearly and precisely on a durable medium: a) of the proposed changes referred to in paragraph 2 and their impact on the price of the package pursuant to paragraph 4; b) of a reasonable period within which the traveler is required to inform the organizer of his or her decision pursuant to paragraph 2; c) of the consequences of the traveler's failure to respond within the period referred to in letter b) and of any alternative package offered and its price. 4. If the changes to the package travel contract or the alternative package referred to in paragraph 2 result in a package of lower quality or cost, the traveler is entitled to an appropriate price reduction. 5. In the event of withdrawal from the package travel contract pursuant to paragraph 2, if the traveler does not accept a replacement package, the organizer shall refund without undue delay and in any case within fourteen days of withdrawal from the contract all payments made by or on behalf of the traveler and the provisions of Article 43, paragraphs 2, 3, 4, 5, 6, 7, 8 CdT shall apply .
10. WITHDRAWAL BY THE TRAVELER (ART. 41 CdT )
1. The traveler may withdraw from the package travel contract at any time before the start of the package by giving written notice to the Agency or Tour Operator , upon payment of standard withdrawal fees (cancellation penalties). 2. The amount of the cancellation penalty will be quantified:
3. In the event of unavoidable and extraordinary circumstances occurring at the place of destination or its immediate vicinity and which significantly affect the performance of the package or the carriage of passengers to the destination, the traveller shall have the right to terminate the contract before the start of the package without paying a termination fee and to a full refund of any payments made for the package, but shall not be entitled to additional compensation. 4 The organizer may withdraw from the package travel contract and offer the traveler a full refund of payments made for the package, but is not required to pay additional compensation if: a) the number of people registered for the package is less than the minimum required by the contract and the organizer communicates the withdrawal from the contract to the traveler within the deadline set in the contract and in any case no later than twenty days before the start of the package in the case of trips lasting more than six days, seven days before the start of the package in the case of trips lasting between two and six days, or forty-eight hours before the start of the package in the case of trips lasting less than two days; b) the organizer is unable to perform the contract due to unavoidable and extraordinary circumstances and communicates the withdrawal from the contract to the traveler without undue delay before the start of the package. 5. The organizer shall proceed with all refunds required under paragraphs 4 and 5 or, with regard to the provisions of paragraphs 1, 2, and 3, shall reimburse any payments made by or on behalf of the traveler for the package after deducting appropriate expenses, without undue delay and in any case within fourteen days of the cancellation. In the cases referred to in paragraphs 4 and 5, any functionally related contracts entered into with third parties shall be terminated.
11. SUBSTITUTIONS AND TRANSFER OF THE TOURIST PACKAGE TO ANOTHER TRAVELER (ART. 38 CdT )
1. The traveler, upon prior notice to the organizer on a durable medium no later than seven days before the start of the package, may transfer the package travel contract to a person who meets all the conditions for using the service. 2. The transferor and the transferee of the package travel contract are jointly liable for the payment of the balance of the price and any fees, taxes, and other additional costs, including any administrative and handling fees, resulting from such transfer. 3. The organizer shall inform the transferor of the actual costs of the transfer, which shall not be unreasonable and shall not exceed the expenses actually incurred by the organizer as a result of the transfer of the package travel contract, and shall provide the transferor with proof of the fees, taxes, or other additional costs resulting from the transfer of the contract. 4. In any case, the Traveller who requests a change to an element relating to a procedure already confirmed, provided that the request does not constitute a contractual novation and provided that its implementation is possible, will pay the Tour Operator , in addition to the expenses resulting from the change itself, a fixed flat rate cost.
12. TRAVELERS' OBLIGATIONS
1. During negotiations and in any case before the contract is finalized, the Traveler will be provided with general written information regarding passports, visas, and the health formalities required for travel abroad. 2. For regulations regarding the travel abroad of minors, please refer to the information provided on the Italian State Police website. It is specified, however, that minors must possess a valid personal document for travel abroad, such as a passport, or, for EU countries, a valid identity card. Regarding the travel abroad of minors under the age of 14 and the travel abroad of minors requiring authorization issued by the Judicial Authority, the provisions set out on the Italian State Police website www.poliziadistato.it/articolo/191/ must be followed . 3. Travelers must obtain the relevant information through their diplomatic representations and/or their respective official government information channels. In any case, travelers must verify their current travel information with the relevant authorities before departure (for Italian citizens, the local police headquarters or the Ministry of Foreign Affairs via the website www.viaggiaresicuri.it or the Telephone Operations Center at 06.491115) and comply with the requirements before traveling. In the absence of such verification, the selling agency or organizer cannot be held responsible for the failure to depart of one or more travelers. 4. Travelers must inform the seller and organizer of their citizenship when booking the travel package or travel service and, upon departure, must definitively ensure that they have vaccination certificates, a personal passport, and any other valid documents for all countries included in the itinerary, as well as any required residence and transit visas and health certificates. 5. Furthermore, in order to assess the socio-political , health, and other relevant information regarding the destination countries and, therefore, the objective usability of the services purchased or to be purchased, the traveler will be responsible for obtaining official general information from the Ministry of Foreign Affairs, as published on the Farnesina's official website www.viaggiaresicuri.it . The above information is not contained in the tour operator catalogues —online or paper—since they contain general descriptive information as indicated in the information brochure and not information that changes over time. Therefore, this information must be obtained by the traveler. Travelers must also comply with the rules of normal prudence and diligence and the specific rules in force in the destination countries, all information provided by the organizer, as well as the regulations and administrative or legislative provisions relating to the travel package. Travelers will be held liable for all damages that the organizer and/or the seller may suffer, including those resulting from failure to comply with the above obligations, including the costs of their repatriation. 6. The organizer or seller who has granted compensation or a price reduction, or paid damages, or has been forced to comply with other obligations prescribed by law, has the right of recourse against those who contributed to the occurrence of the circumstances or event that gave rise to the compensation, price reduction, damages, or other obligations in question, as well as against those required to provide assistance and accommodation services under other provisions, in the event that the traveler is unable to return to the place of departure. The organizer or seller who has compensated the traveler is subrogated, within the limits of the compensation paid, in all the rights and actions of the latter against responsible third parties; the traveler provides the organizer or seller with all documents, information and elements in his possession useful for exercising the right of subrogation (art. 51 quinquies CdT ).
13. ORGANIZER'S LIABILITY REGIME ( ART. 42 CdT )
1. The Organizer is responsible for the performance of the travel services provided for in the package travel contract, regardless of whether such travel services are provided by the Organizer himself, his assistants or agents acting in the exercise of their functions, third parties whose services he uses, or other travel service providers, pursuant to Article 1228 of the Civil Code. 2. The traveler, pursuant to Articles 1175 and 1375 of the Civil Code, shall promptly inform the Organizer, directly or through the seller, of any lack of conformity detected during the performance of a travel service provided for in the package travel contract, taking into account the circumstances of the case. 3. If one of the travel services is not performed as agreed in the package travel contract, the Organizer shall remedy the lack of conformity, unless this proves impossible or excessively onerous, taking into account the extent of the lack of conformity and the value of the travel services affected by the defect. If the Organizer fails to remedy the defect, Article 43 shall apply. 4. Without prejudice to the exceptions set out in paragraph 3, if the Organizer fails to remedy the lack of conformity within a reasonable period set by the traveler in relation to the duration and characteristics of the package, by filing a complaint pursuant to paragraph 2, the traveler may remedy the defect himself and request reimbursement of the necessary, reasonable and documented expenses; if the Organizer refuses to remedy the lack of conformity or if it is necessary to remedy it immediately, the traveler does not need to specify a deadline. 5. If a lack of conformity, pursuant to Article 1455 of the Civil Code, constitutes a significant breach of the travel services included in a package and the Organizer has not remedied it within a reasonable period established by the traveler in relation to the duration and characteristics of the package, by filing a complaint pursuant to paragraph 2, the traveler may, without charge, terminate the package travel contract by operation of law and with immediate effect or, if applicable, request a price reduction pursuant to Article 43, without prejudice to any compensation for damages. In the event of termination of the contract, if the package included passenger transportation, the Organizer will also arrange for the traveler's return with equivalent transportation without undue delay and at no additional cost to the traveler. 6. Where it is impossible to ensure the traveler's return, the Organizer shall cover the costs of necessary accommodation, where possible of an equivalent category to that provided for in the contract, for a period not exceeding three nights per traveler or for the longer period provided for by European Union legislation on passenger rights applicable to the relevant means of transport. 7. The cost limitation referred to in paragraph 6 does not apply to persons with reduced mobility, as defined in Article 2, paragraph 1, letter a), of Regulation (EC) No. 1107/2006, and their accompanying persons, pregnant women, unaccompanied minors, and persons requiring specific medical assistance, provided that the Organizer has been notified of their special needs at least forty-eight hours before the start of the package. The Organizer may not invoke unavoidable and extraordinary circumstances to limit the liability referred to in this paragraph if the transport service provider cannot invoke the same circumstances under applicable European Union legislation. 8. If, due to supervening circumstances beyond the Organizer's control, it is impossible to provide, during the course of the package travel, a substantial portion, in value or quality, of the combination of travel services agreed upon in the package travel contract, the Organizer will offer, at no additional cost to the traveler, suitable alternative solutions of equivalent or superior quality, where possible, to those specified in the contract, so that the package can continue, including in the event that the traveler's return to the place of departure is not provided as agreed. If the proposed alternative solutions result in a package of lower quality than that specified in the package travel contract, the Organizer will grant the traveler an appropriate price reduction. 9. The traveler may reject the proposed alternative solutions only if they are not comparable to what was agreed upon in the package travel contract or if the price reduction granted is inadequate. 10. If it is impossible to provide alternative solutions or the traveler rejects the proposed alternative solutions, in accordance with paragraph 8, the traveler will be granted a price reduction. In the event of failure to comply with the obligation to provide an offer pursuant to paragraph 8, paragraph 5 shall apply. 11. Where, due to supervening circumstances not attributable to the Organizer, it is impossible to ensure the traveler's return as agreed in the package travel contract, paragraphs 6 and 7 shall apply.
14. SELLER'S LIABILITY REGIME (ART. 50 - 51 quater CdT )
1. The Seller is responsible for the execution of the mandate entrusted to it by the traveler under the travel intermediation contract, regardless of whether the service is provided by the seller himself, by his assistants or agents acting in the exercise of their functions, or by third parties whose services he avails himself of. The fulfillment of the assumed obligations must be assessed with regard to the diligence required for the exercise of the corresponding professional activity. 2. The Seller is not responsible for booking errors attributable to the traveler or due to unavoidable and extraordinary circumstances. 3. The traveler's right to compensation for damages related to the Seller's liability expires two years after the traveler's return to the place of departure.
15. LIMITS OF COMPENSATION (ART. 43, paragraph 5)
The package travel contract may provide for a limitation of the compensation due by the organizer, except for personal injury or damage caused intentionally or through negligence, provided that such limitation is not less than three times the total price of the package. The right to compensation for personal injury expires three years after the traveler's return to the place of departure, or for the longer period provided for compensation for personal injury by the provisions governing the services included in the package.
16. POSSIBILITY OF CONTACTING THE ORGANIZER THROUGH THE SELLER (ART. 44 CdT )
1. The Traveller may address messages, requests, or complaints regarding the execution of the package directly to the Seller through whom he or she purchased it, who, in turn, promptly forwards such messages, requests, or complaints to the Organizer. 2. For the purposes of complying with the terms or limitation periods, the date on which the Seller receives the messages, requests, or complaints referred to in paragraph 1 is also considered the date of receipt for the Organizer.
17. OBLIGATION TO PROVIDE ASSISTANCE (ART. 45 CdT )
1. The organizer shall provide adequate assistance without delay to the traveler who finds himself in difficulty, including in the circumstances referred to in Article 42, paragraph 7 of the CdT , in particular by providing appropriate information regarding health services, local authorities, and consular assistance, assisting the traveler in making remote communications, and helping him find alternative travel services. 2. The organizer may request payment of a reasonable fee for such assistance if the problem is caused intentionally by the traveler or through his fault, within the limits of the expenses actually incurred.
CANCELLATION AND REPATRIATION COSTS (ART. 47, paragraph 10 CdT )
Unless expressly included in the price, it is possible and advisable to take out, at the time of booking and through the Seller, special insurance policies against costs arising from cancellation of the package, accidents and/or illnesses, which also cover repatriation costs and loss and/or damage to luggage. Rights arising from insurance contracts must be exercised by the traveler directly against the insurance companies, under the conditions and in the manner set forth in the policies themselves, as set forth in the policy conditions published in the catalogues or in the brochures made available to travellers upon departure.
19. ALTERNATIVE DISPUTE RESOLUTION TOOLS ( ART. 36, paragraph 5, letter g) CdT )
The organizer may offer the traveler—in the catalog, documentation, its website, or otherwise—alternative dispute resolution (ADR ) methods, pursuant to Legislative Decree 206/2005. In this case, the organizer will indicate the type of alternative resolution proposed and the consequences of accepting it.
20. TRAVELER PROTECTION (ART. 47 CdT )
1. The organizer and the seller established in the national territory are covered by civil liability insurance in favor of the traveler for damages resulting from the violation of their respective obligations assumed under the respective contracts. 2. Package travel contracts are supported by insurance policies or bank guarantees or guarantees issued by the Funds referred to in paragraph 3 of Article 47 of the CdT . These, for trips abroad and trips taking place within a single country, including trips within Italy, in the event of insolvency or bankruptcy of the organizer or seller, guarantee, without delay at the traveler's request, the reimbursement of the price paid for the package and the immediate return of the traveler if the package includes transportation of the traveler, as well as, if necessary, payment for food and accommodation before the return. The guarantee is effective, appropriate to the volume of business, and covers reasonably foreseeable costs, the amounts of payments made by or on behalf of travellers in relation to packages, taking into account the length of the period between the deposits and the final balance and the completion of the packages, as well as the estimated cost of repatriation in the event of insolvency or bankruptcy of the organiser or retailer. 3. Travellers benefit from protection in the event of insolvency or bankruptcy of the organiser or retailer regardless of their place of residence, the place of departure, or the place of sale of the package, and regardless of the Member State in which the entity responsible for providing protection in the event of insolvency or bankruptcy is established. 4. In the cases provided for in paragraph 2, as an alternative to reimbursement of the price or immediate return, the traveller may be offered the continuation of the package in accordance with the procedures set out in Articles 40 and 42 of the CdT .
21. OPERATIONAL CHANGES
Given the long-term advance publication of the catalogs containing information on how to use the services, please note that the flight times and routes indicated in the acceptance of the service purchase proposal may be subject to change as they are subject to subsequent validation. To this end, the traveler must request confirmation of the services from their travel agency before departure. The Organizer will inform passengers of the identity of the operating carrier within the timeframe and in the manner required by Article 11 of EC Regulation 2111/2005.

ADDENDUM - General Terms and Conditions of Sale for Individual Tourist Services
A) Regulatory provisions
Contracts for the provision of transportation services only, accommodation services only, or any other separate tourist service cannot be considered a travel arrangement or package, and therefore do not enjoy the protection of the Tourism Code. They are governed by CCV art. 1, art. 3, and no. 6, articles 17 to 23; and articles 24 to 31 (limited to those parts of these provisions that do not refer to the organization contract), as well as by other agreements specifically relating to the sale of the individual service covered by the contract.
In the case of bookings of associated tourist services, pursuant to art. 33, paragraph 1, letter f) of the Tourism Code, the guarantee referred to in art. 49 of the same legislative text applies.
Any seller who undertakes to provide a disaggregated tourist service to third parties, even electronically, is required to provide the tourist with documents relating to this service, which indicate the amount paid for the service and cannot in any way be considered a travel organizer.
B) Contract conditions
The clauses of the general conditions of sale of travel packages listed above apply to these contracts, limited to Articles 7, 10, paragraphs 1 and 2, 12, and 13. The application of these clauses in no way determines the classification of the related services as a travel package. The terminology of the aforementioned clauses relating to the travel package contract (organizer, travel, etc.) should therefore be understood with reference to the corresponding figures in the sales contract for individual travel services (seller, stay, etc.).
C) Complaints
For the sale of stays, any complaints regarding the cleanliness, features, and furnishings of the tourist property covered by the contract must be communicated by the traveler to the agency within one hour of check- in by telephone or text message to the emergency number provided at check -in. After this deadline, the property covered by the stay is considered accepted and fully satisfactory to the traveler in the condition found at check-in.
